1. What you are buying
You are buying a made-to-order novelty item and a short video of it. I print a plaque bearing the word you choose, mount it on a wall at my property, photograph and film it, and send you the resulting video file. That is the whole product. You are not buying the plaque itself, any physical object, any real property interest, any advertising placement, or any promise about who will see it.
2. Term
Your plaque stays mounted for the term shown at checkout, starting from the day it goes up. I may leave it up longer at my sole discretion, and doing so once creates no obligation to do it again. I may take any plaque down at any time, for any reason or none, including before the term ends. If I remove it early for a reason that is not your fault, I will refund the unused part of your term. That refund is your only remedy.
3. Your content, and what you promise about it
"Your Content" means the word, the story, any name, and anything else you submit. By submitting it you promise, and this is the part that matters:
- It is yours, or you have the right to send it.
- It does not accuse, insult, or make claims about any identifiable person other than yourself. Removing a name is not enough — if someone who knows the person could work out who you mean, it counts as identifiable.
- Anything you state as fact is true, to the best of your knowledge.
- It infringes nobody's copyright, trademark, privacy, or publicity rights.
- It is not threatening, harassing, hateful, sexual, or unlawful.
- You are at least 18.
4. Licence you grant me
You grant me a worldwide, perpetual, irrevocable, non-exclusive, fully paid-up, royalty-free, transferable and sublicensable licence to use, reproduce, adapt, edit, translate, perform, display, distribute and publish Your Content, and any recording, photograph, video, voiceover or derivative work made from it, in any medium now known or later invented, for any purpose including advertising and promotion of this and any other project. This licence survives the removal of your plaque and the end of these terms.
You waive any moral rights in Your Content to the fullest extent the law allows. To the extent moral rights cannot be waived where you live, you agree not to assert them against me.
5. No payment, ever, in either direction
You will not be paid, now or later, for Your Content or for any use of it, and you will not be entitled to any share of any revenue, advertising income, sponsorship, licensing fee, or other money that arises from anything I publish. This is true no matter how widely a video is seen and no matter what it earns. You confirm you are not entering into any partnership, joint venture, employment or agency relationship with me.
6. What I own
I own the videos, photographs, edits, voiceovers, music, graphics and the wall itself, and every intellectual property right in them, including in any work that includes Your Content. Nothing here transfers ownership of any of that to you. You may repost the video I send you on your own social accounts. You may not sell it, licence it, run advertising specifically against it, or claim you made it.
7. Voice and narration
Stories may be narrated by a human voice or a synthetic one, edited for length, clarity, pronunciation or legal safety, or set to music. I may shorten your story, change its wording, or decline to narrate it at all. Publishing a video is at my discretion, and I am not obliged to publish anything.
8. My right to refuse
I may refuse or cancel any order, before or after payment, for any reason. If I refuse before the plaque is produced, you get a full refund. If your submission breaks section 3 and I offer you a rewrite, you can take the rewrite or take a full refund.
9. Refunds
Full refund any time before your plaque is produced. Once it is printed and mounted the product has been made for you specifically and is not refundable, except as set out in section 2. If you have a problem, email me before you contact your bank — I would rather fix it than fight a chargeback.
10. Takedown
If you are named on a plaque or in a story and you want it gone, email me. I will take it off the wall and remove the video from any channel I control within 48 hours of confirming your request, at no cost to you. I cannot recall copies other people have already downloaded or reposted.
11. Indemnity
You will defend, indemnify and hold me harmless from any claim, demand, loss, liability, damage, penalty, cost or expense, including reasonable legal fees, arising out of or connected to Your Content or your breach of these terms — including any claim brought by a person you wrote about. This survives the end of these terms.
12. No warranties
Everything here is provided "as is". I make no promise about views, reach, exposure, engagement, sales, uptime, or the commercial value of anything. Colours on screen will not match the printed plaque exactly. The site may be offline sometimes.
13. Limit of liability
To the maximum extent permitted by law, my total liability to you for any claim connected to this service is limited to the amount you actually paid me for the order the claim relates to. I am not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data, goodwill or reputation, even if I was told they were possible. Nothing here limits liability that cannot be limited by law.
14. Privacy
I collect what you give me: your word, your story, your email and whatever Stripe passes on so I can take payment and send you the video. Stripe handles card details; I never see them. I do not sell your data. Your word and story become public on the wall, on this site, and in videos — please do not put anything in them you would not want read out loud by a stranger.
15. Changes
I may change these terms for future orders. The version in force when you paid is the version that governs your order.
16. Law and disputes
These terms are governed by the laws of the State of Arizona, USA, without regard to conflict of laws rules. Any dispute goes to the state or federal courts sitting in Maricopa County, Arizona, and you and I both consent to that. Each of us waives any right to bring or join a class action. If any provision is found unenforceable, the rest stays in force.
17. Whole agreement
These terms and the checkout page are the entire agreement between us about your order.
